City Nights Discos - Customer Terms and Conditions |

All contracts between City Nights Discos and the Customer, require the payment of an agreed upon deposit within 14 (fourteen) days of the initial enquiry, in order to secure the allotted booking. Your payment of the deposit is seen by City Nights Discos, as an acceptance of the following terms and conditions. Your payment of the outstanding balance is to be made to the DJ at the end of the allotted booking, unless previously agreed with City Nights Discos in writing. Payment of the balance to the DJ at the event will be seen as acceptance of your satisfaction with the service received. If requested, City Nights Discos will issue a receipt to the customer for all monies received in connection with an event. On the night of the disco, the customer shall provide a suitable table and power source for the exclusive use of the DJ for the duration of the disco. The minimum power requirements for the disco are two standard plug sockets within 10 meters range of the set up of the equipment. The minimum table size for holding the disco equipment is 6 feet long by 2 feet wide. If supplying a suitable table, or providing access to power is a problem - please let us know in advance so we can supply a suitable table and sufficient extension leads. We will need to know in advance if the venue is up or down more than 14 individual stairs (where a suitable lift is not available for the sole use of the DJ), or if the total distance between the parking and set-up points is over 40 metres. Please note that for combined horizontal and vertical distances; one stair will be counted as the equivalent to 1 metre of distance. Distances from parking to set-up point are by foot using the quickest, safest, most accessible route for carrying the equipment. If City Nights Discos are not pre-warned by the customer about excesses to the above distances, then the DJ, at his discretion, may charge an extra fee up to a maximum of £2.00 per additional stair or meter. This will only come into effect after the first 40 meters, or 14 stairs; has been exceeded. Late start times due to your DJ's lack of foreknowledge about excessive stairs or distances will not be deemed as the DJ's fault, and any time lost will still be chargeable to the customer. Safe parking should be available for the DJ for the duration of the performance and for a reasonable time period prior to and after the performance; for the setting up, loading and breaking down of disco equipment. Any parking fees or parking fines incurred by the DJ during these times will be the customer's responsibility and the customer will be charged accordingly. It is the customer's responsibility to inform City Night Disco's of any height restrictions for vehicular access at the venue. If the DJ cannot gain access as a consequence of any height restrictions then any lost time will be charged to the customer. The services provided as part of the disco entertainment consist of the music selection from the DJ's music library, plus any equipment to play the selected music. The DJ will make every effort to play all requests made by both the customer and guests, but cannot be held responsible if a specific request is not available. The selection of equipment to be used during the event is left to the discretion of the DJ, and is based upon the size, type, condition and location of the event. Whilst every effort is made to ensure that the requested lighting and special-effects are supplied to you - the presence of and use of any specific lighting effect(s) cannot be guaranteed unless they have been specifically hired for the event. In the event that the customer requests the DJ play in excess of the agreed performance times, the DJ will provide a longer performance if the total balance (including this overtime amount) has been paid in full and no other obligations are pending. The absolute minimum hourly rate for overtime is £30 per hour, or part thereof. However as all overtime payments are made personally to and retained by the DJ, the DJ has the right to agree a suitable fee over and above this minimum fee. The customer will be responsible for any damage (normal wear and tear excluded) to any equipment (sound & lighting equipment and / or music library) sustained during the booking, and including a reasonable set-up and pack-up time period associated with this booking. The customer is to provide a safe, non-abusive environment for the DJ. Any mistreatment or abuse of the DJ in any way will result in the immediate discontinuation of services with the full balance still due to City Nights Discos. The DJ is not responsible for power outages, strikes, or acts of God, nor is the DJ's responsible for any equipment that fails during the event. In the unlikely circumstances that equipment does fail, the DJ will; on a best effort basis; find suitable back-up equipment. The DJ is not responsible for any damage to the venue where the services are provided, nor is the DJ responsible for any injuries which may occur, for whatever reason. Whilst every effort is made to ensure that your event will run smoothly. If your DJ is unable to start or the entire time booked cannot be completed; for ANY reason outside of the direct responsibility of the DJ; then the customer will still be liable for the full payment for the entire time booked. Areas outside the responsibility of the DJ include late starts or stoppages for, or due to fire alarms, bouncy or unsuitable flooring, noise limiters, power failures or power outages, acts of God, lock-outs, strikes, insufficient power points, insufficient power, insufficient tables, insufficient space to set-up, or any other set of circumstances deemed by City Nights Discos as outside the direct control of the DJ. If the stoppage is due to the DJ's own equipment failure, then a proportion of the total money due will be deducted from the total amount owed by the customer. City Nights Disco's liability; in circumstances of any kind; will not exceed the total value of the event's booking price. Notice of cancellation by the customer shall be in writing and delivered to City Nights Discos, at least one full calendar month prior to the booked event, in which case a full refund, of any moneys paid; with exception of the deposit; will be returned to the customer. If such notification is not given, the customer will still be liable for the full service fee, including the deposit. The deposit is non-refundable for any reason [other than as stated below], even if the one months notice is given. If the customer, for any reason, fails to settle the outstanding balance at the end of the allotted booking; then the unpaid balance will be subject to a 5% financing / debtor charge. Forms of payment include cash, cheque accompanied by a valid 'Guarantee-Card', and bank transfer. Notice of cancellation by City Nights Discos shall be in writing and delivered to the customer at least one calendar month prior to the booked event, in which case a full refund, if due, will be made. In the extremely unlikely event that the DJ is unable to appear, the DJ will make every effort to find a qualified replacement on a like for like basis. In the unlikely event that a replacement cannot be found, the DJ will make a full refund of any deposit paid by the customer. The customer agrees that the refund will be the full extent of damages he or she is entitled to, and no further damages may be sought against the DJ or City Nights Discos. In the unlikely event that the DJ is delayed and the event does not start
on time due to this, or that time is lost during the event due to equipment
malfunction, the DJ will refund the portion of fees paid proportional
